Some facilities forget to factor in short term or seasonal chemicals they use for projects, specialty blends, or R&D. Section 312 states that you must account for any chemical present at the facility. EPA further describes present as being onsite at any given time during the year above the threshold. EPCRA Section 312 Facilities required to report are those required to prepare or have available material safety data sheets or MSDS under Occupational Safety and Health Administration (OSHA) requirements and which had TPQs of hazardous chemicals present during the previous calendar year. EHS is reportable under EPCRA section 312 if it meets or exceeds the TPQ or 500 pounds if 500 pounds is lower than the TPQ. For example, the TPQ of nitric acid is 1,000 pounds. For nitric acid to be reportable under EPCRA section 302, it must meet or exceed 1,000 pounds. However, nitric acid is reportable under EPCRA section 312 if it meets or exceeds 500 pounds.

EPCRA Sections 312 Emergency Planning and Community Right-to-Know Act (EPCRA) Hazardous Chemical Storage Reporting Requirements 1 Summary Any facility required to prepare or have available Safety Data Sheets (SDSs) for hazardous chemicals/substances under Occupational Safety and Health EPA provided draft guidance in the preamble to the June 8, 1998 proposed rule (63 FR 31268) to streamline the reporting requirements for facilities under sections 311 and 312 of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA). EPA is providing guidance on these reporting options. Under the Emergency Planning & Community Right-to-Know Act (EPCRA) Section 312, you must submit a Tier Two report for your facility if the hazardous or extremely hazardous substances (EHS) you store on site meet or exceed the reporting threshold.
